"Alternative Dispute Resolution"
(ADR)
is the term used to describe all the other options available for settling a dispute that once had to be settled in court. ADR processes such as arbitration,
mediation
and settlement conferences are less formal than court and provide opportunities for litigants to reach an agreement using a problem-solving approach rather than the more adversarial approach of litigation.
Mediation Is Cooperative: In mediation, the parties in a dispute work together with the assistance of the mediator to arrive at a mutually agreeable solution. The mediation process promotes communication, cooperation, and restoration of relationships by negotiation of amicable settlements.
In mediation, the participants explore options and choose a solution that meets their basic needs and is consistent with their sense of fairness.
Mediation Is Confidential: The mediation process protects the parties' interests and legal rights. In order to encourage the free exchange of information, all mediation sessions are confidential.
Mediation Is Empowering: Mediation allows individuals and organizations to maintain control of the decision that affects their future. Mediation is a voluntary process in which participants create solutions that meet their mutual needs and interests. The mediation process also provides the disputing parties an opportunity to communicate their grievance which often allows them to put closure to their dispute.
As a construction professional,
Michael S. Poles brings more than 45 years of business, construction and real estate expertise to the mediation table as a
Non-Lawyer Mediator, and has a propensity to go right to the heart of complex and technical
construction issues being disputed.
Mr. Poles is licensed in
the State of California as a General Building Contractor
(263193-B), a Certified Construction Manager and a Registered
Construction Inspector for schools and hospitals, certified and
licensed as a Special Inspector for structural concrete and masonry, and has inspected hundreds of residential and commercial properties representing the buyers of real estate.
He has built, administrated, and inspected the
construction of projects including: apartments, airports,
commercial, industrial, condominiums, custom homes, fire
stations, hospitals, office and warehouse buildings, police
stations, public schools, shopping centers, public works, and
tract housing.
Mr. Poles has provided Construction Consulting, Forensic Expert Witness and Litigation Support for over
38 years. His experience with the litigation process has been impressive and he has testified at
numerous trials, arbitrations and mediations as a highly credible and effective expert for matters pertaining to
many areas of Design and Construction, Defects, Water Intrusion / Mold, Premises Liability,
Real Estate and Safety.

trained at the Institute for Mediation Studies and the Straus Institute for Dispute Resolution at Pepperdine University School of Law and the
California Academy of Mediation Professionals in concert with the Los Angeles County Superior Court
Program. He has served as a member of the Court
ADR Panel of Mediators
with the Los
Angeles
County Superior Court Alternative Dispute Resolution Program
and provides private mediation services.
As a General
Building Contractor, Construction Manager and a Construction Inspector,
Mr. Poles brings more than 45 years of construction experience and knowledge of complex and highly technical issues to the mediation

Disputes can often be
readily resolved by timely and skillful mediation at the project site
before they get out of control. When
disagreements erupt on the job site between the General Contractor and/or
Subcontractors, they can quickly turn into full-blown disputes that can result in costly schedule delays, defective work or even shut down
the project itself. This can result in expensive and time consuming litigation
between the disputing parties, which can be avoided by early intervention.
In addition to his construction and real estate background,

medical training gained while serving in the United States Naval Hospital
